hat der 4. Senat (Nichtigkeitssenat) des Bundespatentgerichts auf die mündliche

Verhandlung vom 30. Oktober 2012 durch die Richterin Friehe als Vorsitzende

sowie die Richterin Dr. Mittenberger-Huber, die Richter Dipl.-Phys. Dr. Müller und

Dipl.-Ing. Univ. Schmidt-Bilkenroth sowie die Richterin Dipl.-Phys. Univ. Zimmerer

für Recht erkannt:

I. Das europäische Patent 1 418 833 wird mit Wirkung für das

Hoheitsgebiet der Bundesrepublik Deutschland für nichtig erklärt.

II. Die Kosten des Rechtsstreits trägt die Beklagte.

III. Das Urteil ist gegen Sicherheitsleistung in Höhe von 120 %

des zu vollstreckenden Betrages vorläufig vollstreckbar.

Tatbestand§

Die Beklagte ist eingetragene Inhaberin des auch mit Wirkung für Deutschland

erteilten europäischen Patents 1 418 833 (Streitpatent), das am 18. Juni 2002

unter Inanspruchnahme der Priorität der US-Patentanmeldung 298387 P vom

18. Juni 2001 angemeldet wurde. Das Patent betrifft eine schluckbare in vivo-Erfassungskapsel mit einer starre und flexible Abschnitte aufweisenden Leiterplatte

(in der Verfahrenssprache Englisch: swallowable in vivo sensing capsule with a

circuit board having

rigid sections and

flexible sections) und weist

17 Patentansprüche auf, die sämtlich angegriffen sind.

Die erteilten Patentansprüche 1 und 16 lauten in der Verfahrenssprache Englisch

und in deutscher Übersetzung

Hinsichtlich der abhängigen Patentansprüche 2 bis 15 und 17 wird auf die Streitpatentschrift EP 1 418 833 B1 Bezug genommen.

Die Klägerin ist der Ansicht, der Gegenstand des Streitpatents sei unzulässig erweitert und nicht patentfähig und beruft sich insoweit insbesondere auf folgende

Die Klägerin beantragt,

das europäische Patent 1 418 833 mit Wirkung für das Hoheitsgebiet der Bundesrepublik Deutschland in vollem Umfang für nichtig

zu erklären.

Die Beklagte beantragt,

die Klage abzuweisen,

hilfsweise mit der Maßgabe, dass das Streitpatent folgende Fassung erhält (Hilfsantrag 1) [Änderungen jeweils unterstrichen]:

1. A swallowable in vivo sensing capsule (10) comprising:

a circuit board that comprises at least two rigid sections (33,

35) and a flexible section (32‘) connecting said two rigid sections (33, 35), and

one or more batteries (25) positioned between the two rigid

sections (33, 35).

2.

The capsule according to claim 1, further comprising one of a

pH sensor, a temperature sensor, an image sensor (24) and

a pressure sensor.

3.

The capsule according to one of claims 1 or 2, further

comprising a transmitter (26).

4.

The capsule according to claim 1, further comprising at least

one component selected from the group consisting of an illumination source (23), a sensor (24), a processor, a transmitter (26) or a combination thereof.

5.

The capsule according to claim 4 wherein a plurality of

components is disposed on a plurality of rigid sections of the

circuit board.

6.

The capsule according to claim 5, wherein the components

are electrically connected through micro-via in the rigid sections.

7.

The capsule according to claim 1, further comprising a sensor (24) and a transmitte (26), wherein the sensor (24) is disposed on a first rigid section (33) of the circuit board and the

transmitter (26) is disposed on another rigid section (31) of

the circuit board.

8.

The capsule according to one of claims 1 to 7, wherein a plurality of flexible sections is provided and the rigid sections

alternate with the flexible sections.

9.

The capsule according to claim 1, wherein the circuit board is

folded such that the rigid sections of the circuit board are

stacked vertically.

10. The capsule according to claim 1, wherein the rigid sections

are connected by vertical connectors.

11. The capsule according to claim 10, wherein the vertical connectors are electrical conductors.

12. The capsule according to claim 10 or 11, wherein the vertical

connectors are springs (56, 58).

13. The capsule according to claim 12 wherein the springs (56,

58) are conical springs.

14. The capsule according to one of claims 1 to 13, wherein the

circuit board includes flexiglass.

15. The capsule device according to one of claims 1 to 14, one

or both of said rigid sections (33, 35) including a battery

contact.

16. A method for the manufacture of an in vivo capsule comprising the steps of:

disposing at least a sensor on a rigid section of a circuit

board that comprises at least two rigid sections (33, 35) and

a flexible section (32‘) connecting said two rigid sections (33,

35), and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

17. The method of claim 16, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

The capsule according to claim 1, further comprising a sensor (24) and a transmitter (26), wherein the sensor (24) is

disposed on a first rigid section (33) of the circuit board and

the transmitter (26) is disposed on another rigid section (31)

of the circuit board.

The capsule according to claim 1, wherein the circuit board is

folded such that the rigid sections of the circuit board are

stacked vertically.

9.

The capsule according to claim 1, wherein the rigid sections

are connected by vertical connectors.

10. The capsule according to claim 9, wherein the vertical

connectors are electrical conductors.

11. The capsule according to claim 9 or 10, wherein the vertical

connectors are springs (56, 58).

12. The capsule according to claim 11 wherein the springs (56,

58) are conical springs.

13. The capsule according to one of claims 1 to 12, wherein the

circuit board includes flexiglass.

14. The capsule device according to one of claims 1 to 13, one

or both of said rigid sections (33, 35) including a battery

contact.

15. A method for the manufacture of an in vivo capsule comprising the steps of:

disposing at least a sensor on a rigid section of a circuit

board that comprises at least two rigid sections (33, 35) and

a flexible section (32‘) connecting said two rigid sections (33,

35), wherein a plurality of flexible sections is provided and

the rigid sections alternate with the flexible sections, and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

16. The method of claim 15, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

comprising a transmitter (26).

The capsule according to claim 4 wherein at least one component is disposed on at least one of said rigid sections of

the circuit board.

6. The capsule according to claim 5, wherein said at least one

component is electrically connected through micro-via in the

rigid section.

The capsule according to claim 1, further comprising a sensor (24) and a transmitter (26), wherein the sensor (24) is

disposed on a first rigid section (33) of the circuit board and

the transmitter (26) is disposed on another rigid section (31)

of the circuit board.

The capsule according to one of claims 1 to 7, wherein a plurality of flexible sections is provided and the rigid sections

alternate with the flexible sections.

9.

The capsule according to claim 1, wherein the circuit board is

folded such that the rigid sections of the circuit board are

stacked vertically.

10. The capsule according to claim 1, wherein the rigid sections

are connected by vertical connectors.

11. The capsule according to claim 10, wherein the vertical connectors are electrical conductors.

12. The capsule according to claim 10 or 11, wherein the vertical

connectors are springs (56, 58).

13. The capsule according to claim 12 wherein the springs (56,

58) are conical springs.

14. The capsule according to one of claims 1 to 13, wherein the

circuit board includes flexiglass.

15. The capsule device according to one of claims 1 to 14, one

or both of said rigid sections (33, 35) including a battery

contact.

16. A method for the manufacture of an in vivo capsule comprising the steps of:

disposing at least a sensor on a rigid section of a circuit

board that comprises at least two rigid sections (33, 35) and

a flexible section (32‘) connecting said two rigid sections (33,

35), wherein the rigid sections include different material than

the flexible section, and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

17. The method of claim 16, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

The capsule according to one of claims 1 to 7, wherein a plurality of flexible sections is provided and the rigid sections

alternate with the flexible sections.

The capsule according to claim 1, wherein the circuit board is

folded such that the rigid sections of the circuit board are

stacked vertically.

10. The capsule according to claim 1, wherein the rigid sections

are connected by vertical connectors.

16. A method for the manufacture of an in vivo capsule comprising the steps of:

disposing at least a sensor on a rigid section of a circuit

35), wherein the rigid sections include different material than

the flexible section, and

17. The method of claim 16, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

35), wherein a plurality of flexible sections is provided and

the rigid sections alternate with the flexible sections, and the

rigid sections include different material than the flexible sections, and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

16. The method of claim 15, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

The capsule according to one of claims 1 to 7, wherein a plurality of flexible sections is provided and the rigid sections

board that comprises at least two rigid sections (33, 35) and

a flexible section (32‘) connecting said two rigid sections (33,

35), where said flexible section is equal to or less than

4/1000 x 2,54 cm in thickness, and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

17. The method of claim 16, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

the rigid sections alternate with the flexible sections, and said

flexible sections are equal to or less than 4/1000 x 2,54 cm in

thickness, and

folding the circuit board into a housing configured for in vivo

sensing, including positioning one or more batteries (25)

between the two rigid sections (33, 35).

16. The method of claim 15, wherein the step of folding the circuit board includes folding the circuit board such that the rigid

sections of the circuit board are stacked vertically.

Im Übrigen ist die Beklagte der Auffassung, der Gegenstand des Streitpatents sei

nicht unzulässig erweitert, sämtliche beanspruchten Gegenstände seien ursprünglich offenbart. Der Gegenstand des Streitpatents sei in der verteidigten Fassung,

jedenfalls aber in einer der hilfsweise verteidigten Fassungen patentfähig, insbesondere neu und durch den Stand der Technik nicht nahegelegt.

Der Senat hat den Parteien einen Hinweis nach § 83 PatG zugeleitet; zu dessen

Inhalt wird auf Bl. 93 ff. der Akten Bezug genommen.

Entscheidungsgründe§

Die Klage ist zulässig und begründet, denn der Gegenstand des Streitpatents ist

nicht patentfähig (Art. II § 6 Abs. 1 Nrn. 1 und 3 IntPatÜG, Art. 138 Abs. 1 lit. a)

EPÜ).

I.

1. Der Streitpatentgegenstand betrifft nach seinem erteilten Patentanspruch 1

eine schluckbare In-Vivo-Detektierkapsel mit einer Leiterplatte (Schaltungsplatte),

die mindestens zwei starre Abschnitte und einen flexiblen, die zwei starren Abschnitte verbindenden Abschnitt umfasst, und eine oder mehrere zwischen den

zwei starren Abschnitten positionierte Batterien enthält.

In-Vivo-Detektierkapseln mit einem Bildsensor und einem Sender zum Übertragen

der Bilddaten werden verwendet, um Bilddaten beispielsweise vom gastrointestinalen (GI)-Trakt an ein externes Aufnahme-System zu übertragen (vgl. Patentschrift Abs. [0002]). Hierfür ist bekannt, dass sich innerhalb der Kapsel mehrere

Platinen befinden, auf denen die elektronischen Komponenten angebracht sind.

Diese Leiterplatten in der Kapsel können ferner mittels Drähten verbunden sein

(vgl. Patentschrift Abs. [0002]).

Eine weitere Komponente in den bekannten In-Vivo-Detektierkapseln ist die Batterie zur Stromversorgung der Sensorik und des Senders (vgl. Patentschrift

Abs. [0005] und [0006]).

Vor diesem Hintergrund liegt dem Streitpatent sinngemäß die Aufgabe zu Grunde,

die Anordnung der Platinen und der elektrischen Verbindungsleitungen für die

elektronischen Komponenten in einer In-Vivo-Detektierkapsel zu verbessen und

deren Herstellung zu erleichtern.

2. Gelöst werden soll diese Aufgabe durch die streitpatentgemäße In-Vivo-

Detektierkapsel und das Verfahren zur Herstellung einer In-Vivo-Kapsel. Erfindungsgemäß erfolgt die Problemlösung durch eine hinsichtlich der Biegbarkeit

heterogene Leiterplatte, die flexible und starre Bereiche enthält und zwischen denen die Batterie angeordnet ist.

Die nachfolgend wiedergegebene Zeichnung stammt aus der Streitpatentschrift

und zeigt in der Figur 1 beispielhaft eine erfindungsgemäße Anordnung. Dabei bezeichnen die Bezugszeichen 33 und 35 die starren Abschnitte (33, 35), die Bezugszeichen 32 und 32' die flexiblen Abschnitte und das Bezugszeichen 25 die

Batterie.

Die In-Vivo-Detektierkapsel weist entsprechend dem erteilten und mit Hauptantrag

verteidigten, unabhängigen Anspruch 1 folgende Merkmale auf (Merkmalsgliederung hinzugefügt):

4. Als Fachmann muss angesichts der komplexen Vorrichtung aus elektrischer

Sensorik und Videotechnik in einer sehr kompakten, schluckbaren Kapsel ein

Team definiert werden, das aus Diplom-Ingenieuren mit Erfahrungen in der Feinwerktechnik, Elektrotechnik, Optik und der Medizintechnik besteht und deren

Fachkenntnisse sich im Team ergänzen. Dabei ist selbstverständlich, dass das

Team nicht sämtliche Kenntnisse der vier Fachgebiete vereinigt. Jedoch wird dieses Team bei dem vorliegenden Problem der Elektronikanordnung und dem

Schaltungsplattendesign auf das Wissen eines Elektroingenieurs mit Erfahrung im

Leiterplattendesign und -layout zurückgreifen. Dessen Fachkönnen und Fachwissen

ist diesem Team als Fachmann

insgesamt zuzurechnen (vgl. BGH

GRUR 2012, 482, 484 (Rn. 18) – Pfeffersäckchen).

II.

Die Gegenstände des Patentanspruchs 1 in der Fassung nach Hauptantrag und

nach den Hilfsanträgen beruhen nicht auf einer erfinderischen Tätigkeit.

1. Für die Bestimmung des Gegenstands des Streitpatents maßgeblich sind die

Patentansprüche und die darin beanspruchte Lehre, für deren Verständnis durch

den angesprochenen Fachmann auf eine sich am technischen Sinn und nicht an

der philologischen Bedeutung orientierenden Auslegung abzustellen ist. Hierbei ist

an einer am Gesamtzusammenhang orientierten Betrachtung (st. Rspr., vgl. BGH

GRUR 2011, 129, 131 – Fentanyl-TTS m. w. N.) zu beurteilen, welche technische

Lehre Gegenstand des Patentanspruchs ist und welchen technischen Sinngehalt

den Merkmalen des Patentanspruchs im Einzelnen und in ihrer Gesamtheit zukommt.

a.

Im vorliegenden Verfahren sind insbesondere die in Patentanspruch 1

enthaltenen Begriffe „rigid“ (starr, biegesteif) und „flexible“ (flexibel, biegbar) von

Bedeutung. Dem Streitpatent sind hierzu keine Bereichsangaben hinsichtlich der

Biegesteifigkeit oder Elastizität zu entnehmen. Daher ist – wie in der mündlichen

Verhandlung erörtert und von den Parteien bestätigt – diesen Begriffen lediglich zu

entnehmen, dass die beiden in der Patentschrift mit „rigid“ (starr) und „flexible“

(flexibel) bezeichneten Bereiche sich relativ zueinander hinsichtlich der Biegesteifigkeit unterscheiden, d. h. der flexible Bereich biegsamer ist als der starre Bereich. Die Platine („circuit board“) ist hinsichtlich ihrer mechanischen Steifheit heterogen. Da für das Verständnis einzelner Merkmale nicht nur die genannten Eigenschaften, sondern auch die im Zusammenwirken mit den übrigen Merkmalen des

Patentanspruchs bei der Herbeiführung des erfindungsgemäßen Erfolgs sich ergebenden Funktionen zu betrachten sind (BGH GRUR 2012, 1124, 1126 – Polymerschaum m. w. N.), muss der flexible Abschnitt den Zweck erfüllen, dass zwischen zwei starren Abschnitten Batterien positioniert werden können (Merkmal 1.3). Somit ist für die Biegesteifigkeit des flexiblen Abschnitts zumindest vorgegeben, dass Biegeradien in der Größenordnung der Kapseldimensionen möglich sind, um ein Falten der starren Abschnitte um die Batterien zu erlauben. Mittel

zum Erreichen der unterschiedlichen Biegesteifigkeit sind durch den Anspruch 1

nicht vorgegeben, sondern in das Belieben des Fachmanns gestellt. Dem Fachmann ist freigestellt, ob er die unterschiedliche Biegesteifigkeit der Abschnitte beispielsweise durch unterschiedliche Materialien, unterschiedliche Formgebung oder

Dicke der Abschnitte erreicht.

b. Die Eigenschaften „rigid“ und „flexible“ beziehen sich dabei auf Abschnitte der

Leiterplatte („circuit board“). Unter „circuit board“ ist dabei die unbestückte Platine

mit den Leiterbahnen zu verstehen, die als Träger für die Komponenten dient (vgl.

Streitpatent Abs. [0015], Anspruch 16). Unterschiede in der Biegesteifigkeit der

Abschnitte der Platine, die erst durch Bestücken der Bauteile (components) beispielsweise aufgrund des verwendeten Lötzinns entstehen, verändern zwar die

Biegesteifigkeit der bestückten Platine, als Begründung einer unterschiedlichen

Biegesteifigkeit der (unbestückten) Platine können sie jedoch entgegen der Auffassung der Klägerin nicht dienen, da nach dem Wortlaut des Patentanspruchs 16

die unterschiedlich biegesteifen Abschnitte bereits vor der Bestückung vorhanden

sein müssen.

2. Der Gegenstand des Patentanspruchs 1 gemäß Hauptantrag und Hilfsantrag 1 beruht nicht auf einer erfinderischen Tätigkeit. Es kann daher dahinstehen,

ob nach den genannten Fassungen der Gegenstand des Patents unzulässig erweitert ist.

Ausgangslage für die Bemühungen des Fachmanns war die In-Vivo-Detektierkapsel nach der Lehre der Druckschrift D11.

Die Druckschrift D11 beschreibt eine schluckbare In-Vivo-Detektierkapsel (capsule

endoscope) (vgl. D11 S. 9 Z. 1-3) [= Merkmal 1.1].

Um die Verarbeitbarkeit der Baugruppen der Kapsel zu verbessern und deren

Abmessungen zu verringern (vgl. D11 S. 4 Z. 10-14), besitzt diese eine einstückige Leiterplatte (circuit board 100) (vgl. D11 S. 9 Z. 22-23, Fig. 1, 4)

[= Merkmal 1.2], die mehrere Abschnitte (circular circuit board 110, 120, 130 und

connection strip board 150) enthält (vgl. D11 Fig. 4).

.

Diese einstückige Platine (100) wird vor dem Einbau an den Abschnitten 110, 120

und 130 mit den elektrischen Komponenten (image sensor 110, image sensor

control electric part 212, signal transmission electric part 130) versehen. Zum Einbau in die Kapsel wird die Platine an den Abschnitten (connection strip board 150)

gefaltet und zusätzlich mit einem Abstandshalter durch Klebung gesichert (vgl.

D11 S. 9 Z. 21 -S. 10 Z. 4). Im eingebauten Zustand sind die Abschnitte 110, 120

und 130 jeweils parallel zueinander angeordnet (vgl. D11 S. 8 Z. 3-4, Fig. 3, 5).

Dabei sind die Abschnitte (connection strip board 150), die die Abschnitte (circular

circuit board 110, 120, 130) verbinden, zumindest an den Faltkanten biegsam

(„flexible“ analog zu Anspruch 1) (vgl. D11 S. 9 Z. 23-S. 10 Z. 1: „If the circuit

board 100 is bent by simply folding …“ i. V. m. Fig. 3, 5), da eine starre Platine

ohne Beschädigung

nicht

gefaltet werden

kann

[= Merkmal 1.2.2].

Weiter ist in der Druckschrift D11 gezeigt, zwischen den Abschnitten 120 und 130

die Batterie (battery 101) zu positionieren (vgl. D11 S. 10 Z. 9-11: „…that the battery 101 is interposed between the second circular circuit board 120 and the third

circular cicuit board 130“, Fig. 5) [= Merkmal 1.3]. Hierfür weist die Platine am Abschnitt 130 zusätzlich eine Feder (compression spring for battery) zur Halterung

und Kontaktierung der Batterie auf (vgl. D11 S. 10 Z. 12-22, Fig. 3, 5).

Von der Kapsel nach der Druckschrift D11 unterscheidet sich die In-Vivo-Detektierkapsel nach Patentanspruch 1 des Streitpatents nur durch die explizite Angabe, dass die Abschnitte 110, 120 und 130 starr sind [=Merkmal 1.2.1].

Es kann dahin stehen, ob sich die Biegesteifigkeit der Abschnitte 110, 120 und

130 und die Biegesteifigkeit der Abschnitte 150 bereits aufgrund der unterschiedlichen Formen der Abschnitte unterscheiden und damit auch das Merkmal 1.2.1

erfüllt ist. Der Fachmann wird nämlich ohnehin erwarten, dass eine kreisrunde und

größere Fläche nach den Abschnitten 110, 120 und 130 starrer ist als das

schmale Band der Abschnitte 150. Die unterschiedliche Ausgestaltung der Biegesteifigkeit dieser Abschnitte ergibt sich – wie die nachfolgenden Ausführungen

zeigen – für den Fachmann aber jedenfalls in nahe liegender Weise entweder unter Zuhilfenahme seines Fachwissens oder in Verbindung mit den Anregungen,

die ihm die Druckschrift D14 bot.

Die unterschiedliche Ausgestaltung der Biegesteifigkeit der Abschnitte 110, 120,

130 und 150 ergab sich für den Fachmann als anzustrebendes Ziel bereits daraus,

dass auf den Abschnitten 110, 120 und 130 Bauteile positioniert sind (vgl. D11

Fig. 4). Bestehen die Abschnitte 110, 120 und 130 und die biegbaren Abschnitte

150 einstückig aus demselben flexiblen Material und werden die Abschnitte nach

der in Fig. 5 dargestellten Weise gefaltet, so kommt es zwangsläufig zu einem

Biegemoment in der Platine, wodurch die Kontaktierungen der Bauteile aufgrund

der starren Lötstellen beschädigt werden können. Dadurch ist ein elektrischer

Kontakt zwischen den Leiterbahnen und den Komponenten nicht mehr gegeben

und die Funktionsfähigkeit der elektrischen Schaltung in der In-Vivo-Detektierkapsel nicht mehr sichergestellt.

Für den Fachmann stellt sich die Forderung, nach Lösungen zu suchen, die sowohl ein Umbiegen der Abschnitte 150 erlaubt als auch ein Verbiegen der Abschnitte 110, 120, 130 und damit eine Beschädigung der Kontaktierungen vermeidet. Dies leitet sich unmittelbar aus der Berufserfahrung des Fachmanns hinsichtlich des Leiterplattendesigns ab, die ihm daher eine Anregung gab, die Biegesteifigkeit für den jeweiligen Zweck anzupassen.

Auch aus der Druckschrift D11 erhält der Fachmann die Anregung die Biegesteifigkeit der Abschnitte unterschiedlich zu gestalten. In der Druckschrift D11 ist

beschrieben, dass es beim Falten der Platine zu einem Rückbiegen kommt (vgl.

D11 S. 9 letzter Absatz „If the circuit board 100 ist bent by simply folding, the

shape of the circuit board 100 cannot be maintained constant because it easily

returns to its original shape“). Dies führt nach dem Falten zu einer Spannung in

der Platine in eingebautem Zustand, was wiederum zu einer Beschädigung der

elektrischen Kontaktierungen führen kann, zumindest jedoch zu Instabilitäten.

Gelöst wird dies in der Druckschrift D11 durch ein zusätzliches Element (spacer 102). Durch dieses zusätzliche Element wird jedoch die gewünschte verbesserte Verarbeitung bei der Herstellung erschwert.

Damit stellt sich für den Fachmann die objektive Aufgabe, einerseits die Platine in

den Abschnitten 110, 120 und 130 derart auszubilden, dass möglichst kein Biegemoment an der bestückten Platine auftritt, und andererseits die Abschnitte 150

derart zu gestalten, dass nach Falten der Platine keine Spannung an den gebogenen Abschnitten 150 auftritt. Dabei wird er das in der Druckschrift D11 als Vorteil

erkannte Prinzip einer einzigen Platine, die gefaltet wird, nicht aufgeben. Er

musste also prüfen, ob eine Möglichkeit bestand, ein Falten zu verwirklichen, ohne

die Platine in Einzelabschnitte zu teilen. Der Fachmann war deshalb in hohem

Maß veranlasst, nach Lösungen suchen, die eine unterschiedliche Biegesteifigkeit

der Abschnitte der Platine erreichen.

Es liegt für den Fachmann auf der Hand, diese zwei sich widersprechenden Anforderungen durch Ausgestaltung von unterschiedlichen Abschnitten zu realisieren, die Platine also heterogen auszubilden. Dabei war für das Team aus Diplom-

Ingenieuren mit Kenntnissen im Leiterplattendesign geläufig, dass Platinen heterogen ausgebildet werden können. Um zu erkennen, dass das Ziel der Heterogenität der Abschnitte hinsichtlich der Biegesteifigkeit dadurch erzielt werden kann,

dass starre und flexible Abschnitte in der Platine verwirklicht werden, musste der

Fachmann auf seinem Gebiet weder überdurchschnittlich befähigt sein, noch

musste er erhebliche gedankliche Kreativität entfalten. Er hat aufgrund seiner

Fachkunde und Erfahrung eine generelle Vorstellung von den für eine Platine in

Frage kommenden Materialien und deren Anordnung. Er kommt somit bereits mit

Hilfe seines Fachkönnens in nahe liegender Weise zur Detektierkapsel nach Anspruch 1.

Sollte er nicht bereits durch seine Fachkunde die Platine nach der Druckschrift

D11 mit den Abschnitten realisieren können, wird er im Stand der Technik nach

Lösungen für Platinen mit unterschiedlichen Biegesteifigkeiten suchen. Diese hat

er in der Druckschrift D14 gefunden, wenngleich sie nicht unmittelbar zum technischen Spezialgebiet gehörte.

Über den zum jeweiligen technischen Spezialgebiet gehörenden Stand der Technik hinaus ist nämlich das zu berücksichtigen, was sich der maßgebliche Durchschnittsfachmann bei seiner Ausbildung an allgemeinem Grundlagenwissen angeeignet hat. Zusätzlich ist das Wissen auf technischen Nachbargebieten oder auf

einem übergeordneten allgemeinen technischen Gebiet heranzuziehen, auf dem

sich in größerem Umfang gleiche oder ähnliche Probleme stellen (vgl. BGH

BlPMZ 1989, 133 re. Sp. – Gurtumlenkung).

Wesentlich ist einmal die technologische Nähe der beiden Fachgebiete, zum anderen aber auch die von dem jeweiligen durchschnittlichen Ausbildungs- und Erfahrungsniveau abhängige Fähigkeit des Fachmanns, überhaupt zu erkennen,

dass er die Lösung für sein spezielles Problem auf einem anderen Fachgebiet suchen und finden kann, sei es durch eigene Recherchen, sei es durch gezielte Befragung des für das andere Gebiet zuständigen Spezialisten; es kommt stets darauf an, ob von dem Durchschnittsfachmann im konkreten Fall erwartet werden

kann, dass er sich für die Lösung eines bestimmten Problems auch auf einem anderen technischen Gebiet umsieht.

Das objektive Problem der Ausbildung der Platine mit verschiedenen Eigenschaften verfolgend, zog der Fachmann als erfolgversprechend auch den Stand der

Technik zum Platinenlayout im Allgemeinen heran, da er auf diesem übergeordneten Fachgebiet die Lösung oder jedenfalls einen weiteren Fingerzeig für seine

Problemlösung erwarten konnte.

In der Druckschrift D14 findet der Fachmann eine derartige Problemlösung. Da in

der Druckschrift D14 ebenfalls das Problem besteht, dass die Platine einerseits

Abschnitte zur Aufnahme der elektronischen Komponenten und andererseits faltbare Bereiche besitzen soll (vgl. D14 Sp. 1 Z. 12-22), hatte er auch Anlass sich mit

dieser Schrift zu beschäftigen. Die Druckschrift D14 zeigt eine Platine mit mehreren in ihrer Biegesteifigkeit unterschiedlichen Abschnitten. So sind in der Fig. 1 der

Druckschrift D14 starre Abschnitte (rigid printed circuit sections 11) und flexible

Abschnitte (flexible printed circuit sections 12) einer Platine offenbart (vgl. D14

Sp. 7 Z. 22-30, Fig. 1). Aus dieser Druckschrift erhält der Fachmann die technische Lehre, eine Platine mit unterschiedlichen Abschnitten auszubilden, wobei die

Abschnitte unterschiedlich flexibel sind.

Danach brauchte er das in der Druckschrift D14 genannte Platinenlayout mit den

unterschiedlichen Abschnitten nur auf die Platine der Detektierkapsel nach der

Druckschrift D11 zu übertragen, um zum Gegenstand des Patentanspruchs 1 in

der Fassung nach Hauptantrag zu gelangen. Eine komplexe Anpassung der aus

der Druckschrift D11 bekannten Detektierkapsel war dazu nicht notwendig. Es genügte, lediglich die aus den Druckschriften D11 und D14 bekannten Lösungsansätze in nahe liegender Weise zu kombinieren.

3.

Im Patentanspruch 1 in der mit dem Hilfsantrag 2 verteidigten Fassung wurden gegenüber Haupt- und Hilfsantrag 1 folgende Merkmale hinzugefügt (Merkmalsgliederung hinzugefügt):

Dieser eingeschränkte Gegenstand ergibt sich für den Fachmann gleichfalls in naheliegender Weise aus dem Stand der Technik nach den Druckschriften D11 und

D14 in Verbindung mit dem Fachwissen, denn die zusätzlichen Merkmale sind bereits aus der Druckschrift D11 bekannt.

Auch die Vorrichtung nach der Druckschrift D11 weist mehrere flexible Abschnitte (150) und Abschnitte (110, 120, 130) mit Bauteilen auf, die sich abwechseln (vgl. D11 Fig. 5). Damit gelangt der Fachmann in nahe liegender Weise –

analog zu den Gegenständen nach Haupt- und Hilfsantrag 1 – zum Gegenstand

nach Anspruch 1 in der Fassung des Hilfsantrags 2.

4. Nach Patentanspruch 1 in der mit den Hilfsanträgen 3 und 3A verteidigten

Fassungen weist die beanspruchte Vorrichtung gegenüber der Vorrichtung nach

Hauptantrag folgendes zusätzliche Merkmal auf (Merkmalsgliederung hinzugefügt):

Auch diese eingeschränkten Gegenstände ergeben sich für den Fachmann in naheliegender Weise aus dem Stand der Technik nach den Druckschriften D11 und

D14 in Verbindung mit dem Fachwissen.

Werden die Abschnitte vom Fachmann mit unterschiedlichen und insbesondere

diametralen Eigenschaften (starr, flexibel) ausgebildet, so liegt es für ihn auf der

Hand, hierfür unterschiedliche Materialien zu verwenden.

Bereits aufgrund der gewünschten Bestückung der starren im Unterschied zu den

flexiblen Abschnitten wird der Fachmann unterschiedliche Materialien vorsehen,

da für eine Bestückung im Allgemeinen ein Lötstopplack, ein Bestückungsdruck

o.ä. vorhanden ist, was bei einer reinen Verbindungsplatine ohne Bauteile (flexible

Abschnitte) nicht erforderlich ist.

Ferner werden unterschiedliche Materialien der starren und flexiblen Abschnitte

auch

bei

der

Leiterplatte

nach

der Druckschrift D14

verwendet

[= Merkmal 1.5/1.5‘]. So sollen die flexiblen Abschnitte (flexible printed circuit) mit

Kapton/Polyamid bedeckt sein, um deren Reißfestigkeit zu erhöhen (vgl. D14

Sp. 6 Z. 43-56). Weiter ist offenbart, dass die starren Abschnitte Schichten aus –

relativ starrem – Glasfaser/Epoxy-Material aufweisen, die flexiblen Abschnitte hingegen diese Schichten nicht enthalten (vgl. D14 Sp. 7 Z. 58-65, Fig. 2).

Überträgt der Fachmann die aus der Druckschrift D14 bekannte Materialauswahl

auf die Platine nach Druckschrift D11, ist er bereits in nahe liegender Weise zu

den Gegenständen der Hilfsanträge 3, 3A und 3B gelangt.

Im Patentanspruch 1 nach den Hilfsanträgen 4 und 4A wurde der erteilte Anspruch 1 durch das folgende, zusätzliche Merkmal eingeschränkt:

Im Patentanspruch 1 in der mit dem Hilfsantrag 4B verteidigten Fassung weist

die Vorrichtung gegenüber der Vorrichtung nach Hauptantrag die zusätzlichen

Merkmale nach Hilfsantrag 2 und 4 auf (Merkmalsgliederung hinzugefügt):

Diese eingeschränkten Gegenstände ergeben sich für den Fachmann in naheliegender Weise aus dem Stand der Technik nach den Druckschriften D11 und D14

in Verbindung mit dem Fachwissen.

In der Druckschrift D14 sind unterschiedliche Werte für die Dicke der Leiterplatte

angegeben, u. a. weniger als 12 oder 10 mils, aber auch weniger als 8 mils (vgl.

D14 Sp. 5 Z.1-5). Als Anwendungsgebiete sind in der Druckschrift D14 „komplexe

elektronische Geräte“, u.a. Laptops oder Notebooks, genannt (vgl. D14 Sp. 9

Z. 22-27).

Die Dimension dieser Geräte ist wesentlich größer als die Dimension von In-Vivo-

Detektierkapseln. Ferner ist für den Fachmann die Verkleinerung der Kapseldimensionen ein wesentliches Entwicklungsziel, da dies die Schluckbarkeit und

Darmdurchgängigkeit der Kapsel verbessert. Aufgrund der Größenunterschiede

zwischen der oben genannten Consumer Elektronik und einer Detektierkapsel

wird der Fachmann auch die in der Consumer Elektronik bekannte Platinendicke

bei dem Einsatz in einer Detektierkapsel weiter verringern. Eine Verringerung der

Platinendicke, wie sie beispielsweise in der Druckschrift D14 offenbart ist, um die

Hälfte, also von 8 auf 4 mils, liegt dabei aufgrund des genannten Größenunterschieds im fachmännischen Handeln. Der Fachmann wird eine geeignete Dicke

der Schaltungsplatte durch orientierende Versuche ermitteln. Da hinsichtlich der

Dicke nach Merkmal 1.6 kein überraschender Effekt ersichtlich ist, kann damit

auch diese Materialeigenschaft keine erfinderische Tätigkeit begründen. Dabei ist

zu beachten, dass die Reißfestigkeit bei einer geringeren Platinendicke verringert

ist. Jedoch erkennt der Fachmann aufgrund seines Fachkönnens, dass er dieses

Problem vernachlässigen kann, da bei einer in einer Detektierkapsel fest eingebauten Platine geringere Anforderungen an die Reißfestigkeit zu stellen sind als

bei einer Platine für Consumer-Elektronik, Laptops o. ä., da diese Platinen vom

Benutzer ein-/ausgebaut werden.

6. Das mit Patentanspruch 16 nach Hauptantrag und nach Hilfsanträgen 1, 3,

3A, 4 und 4A, sowie mit Patentanspruch 15 nach Hilfsanträgen 2, 3B und 4B unter

Schutz gestellte Verfahren kann ebenso wenig als auf einer erfinderischen Tätigkeit beruhend gelten wie die Vorrichtung nach Anspruch 1 selbst.

Die Merkmale 16.1 und 16.2.1 des Verfahrens nach Anspruch 16 gehen nicht über

die zwangsläufig vorhandenen Herstellungsschritte einer Kapsel nach Anspruch 1

mit den Merkmalen 1.1, 1.2.1, 1.2.2 und 1.3 hinaus, da diese Merkmale lediglich

eine Einkleidung der Vorrichtungsmerkmale in Herstellungsschritte darstellen. Mit

den Ausführungen zu Anspruch 1 folgt daher, dass sich die Merkmale 16.1 und

16.2.1 ebenfalls in nahe liegender Weise aus dem Stand der Technik ergeben.

Weiter ist in der Druckschrift D11 offenbart, dass auf dem Abschnitt 110 ein Sensor (image sensor 111) angeordnet ist (vgl. D11 S. 7 Z. 4-5: „An image sensor 111

is fastened to the surface of the first circular board“, Fig. 4). Wie oben gezeigt, wird

der Fachmann den Abschnitt sinnvollerweise starr ausführen und gelangt damit in

nahe liegender Weise zum Merkmal 16.2.

Ferner ist in der Druckschrift D11 beschrieben, die Schaltungsplatte 100 in ein

Gehäuse (main block 10) mit Zylinder (electric element holding cylinder 13) mit

Hilfe eines Abstandhalters (spacer 102) durch Faltung einzupassen (vgl. D11 S. 9

Z. 23-S. 10 Z. 6, Fig. 2, 3, 5). Dieses Gehäuse 10 ist aufgrund der transparenten

Abdeckung (transparent cover 17) und des Bildsensors 111 für eine In-Vivo-Bildaufnahme konfiguriert (vgl. D11 S. 12 Z. 21-S. 13 Z. 7). In der Druckschrift D11 ist

auch offenbart, eine Batterie zwischen den Abschnitten 120 und 130 zu positionieren (S. 10 Z. 7-11 Fig. 3, 5). Damit ist auch das Merkmal 16.3 in der Druckschrift

D14 gezeigt.

Mit diesen Überlegungen ist der Fachmann jedoch bereits in nahe liegender

Weise beim Verfahren nach Patentanspruch 16 bzw. Patentanspruch 15 in den

Hilfsanträgen 2, 3B und 4B angelangt.

7. Hinsichtlich der Gegenstände der Unteransprüche ist eine eigene erfinderische Leistung weder geltend gemacht noch sonst ersichtlich (BGH GRUR 2012,

149, 156 – Sensoranordnung).

III.

Die Kostenentscheidung beruht auf § 84 Abs. 2 PatG i. V. m. § 91 Abs. 1 ZPO, die

Entscheidung zur vorläufigen Vollstreckbarkeit auf § 99 Abs. 1 PatG i. V. m. § 709

ZPO.
